Shoplifting Offenses under Florida Law

According to Fla. Stat. §812.015, an individual can be charged with shoplifting if:

  • The individual takes possession of a store’s merchandise, property or money that belongs to the store with the intent to deprive the merchant of the retail value or benefit of the item;
  • The individual alters, changes, or removes price labels or tags on merchandise; transfers items from one package to another; or takes a shopping cart from a store; or
  • The individual removes anti-shoplifting devices without being in lawful possession.

Penalties for Shoplifting in Florida

The penalties for shoplifting in Walton County will be dependent on factors such as the amount that was allegedly stolen and previous convictions. These factors will decide whether the offense will be termed petty/petit theft (less than $300) or grand theft ($300 or more). Such factors include:

  • An individual charged with petite theft in the second degree could be convicted of a misdemeanor of the second degree, which is punishable by a fine up to $500 and/or a jail sentence up to 60 days.
  • An individual charged with petit theft in the first degree could be convicted of a misdemeanor of the first degree, which is punishable by a fine up to $1,000 and/or a jail sentence up to one year.
  • An individual charged with retail theft in an amount of $300 or more could be convicted of a felony of the third degree, which is punishable by a fine up to $5,000 and/or a prison sentence up to five years.
  • An individual charged with shoplifting in an amount of $3,000 or more could be convicted of a felony of the second degree, which is punishable by a prison sentence up to 15 years and/or a fine of no more than $10,000.
  • An individual charged with grand theft in the first degree could be convicted of a felony of the first degree, which is punishable by a fine up to $10,000 and/or up to 30 years or life in prison.
